3.2 Authority to Bind If you are using Interviewkit.ai on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms and Conditions.

4. Account Registration

4.1 Account Creation To access our services, you must create an account by providing accurate and complete information, including your name and email address. You are responsible for keeping this information up to date.

4.2 Account Security You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hi@interviewkit.ai if you suspect any unauthorized access to your account.

4.3 Account Responsibility You are fully responsible for all activity that occurs under your account. Interviewkit.ai is not liable for any loss or damage arising from unauthorized use of your account.

5. Acceptable Use

5.1 Permitted Use Interviewkit.ai is intended to be used by recruiters and HR teams to conduct AI-powered interviews with candidates for legitimate hiring purposes.

5.2 Prohibited Use You agree not to: - Use the platform for any unlawful, harmful, or fraudulent purpose - Impersonate any person or entity - Attempt to reverse-engineer, copy, or replicate our AI interview technology - Upload or transmit any malicious code, viruses, or harmful content - Use the platform to harass, discriminate against, or harm candidates or other users - Share, resell, or sublicense access to our platform without prior written consent - Attempt to gain unauthorized access to our systems or other user accounts

5.3 Consequences of Misuse We reserve the right to suspend or terminate your account, without notice, if we determine that you have violated these Terms. Interviewkit.ai's decision in such matters is final.

6. Plans and Payments

6.1 Free Plan Interviewkit.ai offers a free plan with limited access to features. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

6.2 Paid Plans Paid plans are available with expanded features and usage limits. By subscribing to a paid plan, you agree to pay all applicable fees associated with the plan you select.

6.3 Billing All fees are billed in advance and are non-negotiable. You authorize Interviewkit.ai to charge your selected payment method for all applicable fees.

6.4 No Refunds All payments made to Interviewkit.ai are final and non-refundable. We do not offer refunds, credits, or exchanges for any reason, including unused portions of a subscription, plan downgrades, or account termination.

6.5 Plan Changes We reserve the right to change our pricing or modify plan features at any time. We will notify you at least 30 days in advance of any price changes via email.

7. Intellectual Property

7.1 Our Content All content, features, and technology on Interviewkit.ai — including but not limited to the AI interview engine, interface design, logos, and trademarks — are the exclusive property of Interviewkit.ai and are protected by applicable intellectual property laws.

7.2 Your Content You retain ownership of any content you upload or generate on the platform, such as interview transcripts. By using our platform, you grant Interviewkit.ai a limited, non-exclusive license to process and store this content solely to provide our services.

7.3 Restrictions You may not copy, reproduce, distribute, or create derivative works from any part of our platform without our prior written consent.

8. Candidate Privacy and Consent

8.1 Recruiter Responsibility As a recruiter or HR professional using Interviewkit.ai, you are responsible for ensuring that candidates are informed about and have consented to participating in an AI-powered interview before the session begins.

8.2 Compliance with Laws You agree to use our platform in compliance with all applicable employment, privacy, and anti-discrimination laws in your jurisdiction.

9. Disclaimers

9.1 No Guarantee of Results Interviewkit.ai does not guarantee that our platform will meet your specific hiring needs or produce any particular outcome. The platform is provided as a tool to assist in the interview process and should not be the sole basis for hiring decisions.

9.2 Service Availability We strive to maintain uninterrupted access to our platform but do not guarantee that the service will be available at all times. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.

9.3 As-Is Service Our platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, Interviewkit.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform — including but not limited to loss of data, loss of revenue, or hiring-related outcomes. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

11. Termination

11.1 By You You may close your account at any time by contacting us at hi@interviewkit.ai. Termination does not entitle you to a refund of any paid fees.

11.2 By Us We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in misuse of the platform, or for any other reason at our sole discretion. We will endeavor to notify you via email where reasonably possible.

12. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services or for legal and operational reasons.
